The English version of the Note of the Ministry of Food and Agriculture(MAA),

NOTE

After studying the complete documentation that was laid down as a result of the solicitation of MAA regarding the situation of the Romanian chinologycal movement, from the juridical and factual point of view were considered the following:
1. The legal existence of the chinologycal associations:

a.The Chinologycal Association from Romania (AChR)-registered on the 3rd of September 1976, under the initial name of Romanian Chinologycal Association from RSR, founded by the General Assembly of the Founding Members on the 10th of May 1975, based in Calea Mosilor, no.128, registered with the file no.4407/PJ/1976 at the Court of Law no.3, Bucharest.
Its president is Mr. Vasile Maier, beginning on the 20th of July, 1996, according to the Ruling of the Court of Law no.2, Bucharest, pronounced on 30th of June, 1999, in the same file no.4407/PJ/1976.

b.The Union of the Independent Chinologycal Association in Romania(UAChIR) founded on the 21st of September 1990, file no. 2097/PJ/1990, Court of Law no. 1, Bucharest, based in Bucharest, Popa Tatu Street, no.61, sector.1.

Other elements regarding the identification of the hereabove mentioned were not received till the deadline was due according to the convocation letter of MAA, the Cabinet of the Minister no. 1267/05/19/2000.

c.The National Club of Romanian Shepherd dogs (CNCCR)-registered on the 13th of April 1998, founded by the General Assembley of the Founding Members in December 1997, registered by Civil Sentence no.54, file no. 73/PJ/1998, TMB section 4 Civil. CNCCR is based in Dionisie Lupu, 47, Bucharest and is represented by Mr. Cezar Osiceanu as a president, from the day of entering into force up to the present.

2- The Ministery of Food and Agriculture authorized the three associations and granted:

a)The functioning notification necessary to obtain juridical status;
b)The acknowledgement of AchR-Calea Mosilor, 128, as the one and only specialized organization having the right to be represented at the International Chinologycal Federation

(FCI)-by the MAA letter- the Cabinet of the Minister no.2096/09/02/1996, that later on was completed by
CNCCRpg.4

c)MAA letter- the Cabinet of the Secretary of State no.17176/AD/09/28/1998 where CNCCR is named as the only habilitated organization to represent at the national and international level the issues regarding the Romanian Shepherd Dogs.

In the particular case of the CNCCR, the notification and the decision of representation was granted after a preliminary verification of its results from juridical and organizational point of view.

3. From the analysis and verification of the whole documentation that were laid down at the file by each of the three associations convened, came out the following:

a)The existence of two associations that pretend to be identically named (AChR), having two different boards, headquarters and bank accounts, fact that is not according to the law in force.
b)The existence of a certain number of trails in the last 5 years and still unsolved between the two
associations mentioned at a) above

c)The distruction of the database regarding the records of all the pedigree dogs in Romania; this situation appeared by using double records, lack of control of the modalities of registration, evidence and issuance of the papers of origin (pedigree), and by the illegal usage of the signs and distinguishing marks of some international institutions where Romania is a member(UAChIR) used the sigle of the FCI on the papers of origin issued between 1990 and 1995

d)The repeated and systematical violation of the national and international norms regarding the registration and the correct issuance on time of the pedigrees (not to use the Romanian language in the official papers, to use in the same time several types of pedigrees, the uncontrolled
changing of the pedigrees of the dogs that come from countried that are not members of FCI

e)The very bad results got by the two rival fractions of AChR and by the UAChIR in the national and international competitions led to the revokation by FCI of the results obtain in international contests that took place in Romania betwwn 1990-1995
All these led to the scission of the Romanian chinologycal movement and to maintain the status of Romania as associated member of FCI instead of having already the status of full member, as it would have been normal as the result of the positive evolution of the national chinology.
As an important consequence of disobeying the juridical decisions as they were issued by the Court of Law, it is very probable for Romania to be excluded from FCI, as a result of a possible revocation of the whole activity of the national chinology registered at FCI after 17th, March, 1999.
When the Civil Decision nno.606/filr5012/1998 of the Court of Appeal, Bucharest, sector III Civil was pronounced , and the violation of the Protocol of Unification signed between the two parts in conflict that had as due time to be applied on the 15thof November, 1999.

4. The outrunning of the legal attribution by AChR and UAChIR, attributions that are stipulated into the decisions of MAA, has been made by:
a) unauthorized and unregistered Customs Examinations

b) the illegal setting up and cashing of some Customs examination taxes

c) the violation of the copyright by imposing a tax for international protection of the affix of breeder

d) the violation of the legislation in force regarding the cashing , registration and declaration of the sums of money in foreign currency from Romanian citizens.

5. Regarding the problem of international homologation of the native breeds of dogs, were considered the following:
a) The lack of certain texts of breed standards for Romanian Shepherd dogs till April 1998 in the archive of MAA, although the request for their registration was approved before 1989 by the minister of agriculture in charge at that time

b)The incorrect and incomplete homologation file of Romanian Shepherd dogs , sent by AChR in 1995 to FCI and rejected as it was (the file contained instead of 8blood lines on the generation only 5, the names of the nests did not follow the international norms , the photo section was useless because of the technical quality of the photographs and of the samples photographed, the translations were inaccurate) as it
is obvious from the reply sent by the President of the Standards Commission of FCI at that time.

c)To strictly follow the norms and demands regarding the zoometric measures necessary for a correct standardization of Romanian Shepherd dogs was performed only on the 12th of April, 1998, by CNCCR,the Faculty of Veterenary Medicine in Bucharest, belonging to the University of Agriculture and Veterenary Medicine in Bucharest. A mixed team formed by representatives of CNCCR, Faculty of Veterenary Medicine and referees of AChR, Calea Mosilor, 128, led by PhD. Ioan Miclaus, the Dean of the Faculty of Veterinary Medicine examined a number of 426 samples from all over the country.
At this action were also invited referees of CNCCR -Popa Tatu, 61 Mr. Attila Kelemen included, who officially refused to officiate.

d)The official registration of the only standards in force for Romanian Shepherd dogs at MAA was made on the basis of the common request of CNCCR and Faculty of Veterenary Medicine , Bucharest, in April 1998.

e)The deficient registration activity of Romanian Shepherd dogs by the two rival factions from AChR and UAChIR was performed by: the usage of incomplete pedigrees , unregistered, unissued, mistaken and even false.

f)The disobeying of the persons hereabove mentioned of the authority that CNCCR was invested by MAA by facts that are against both the legislation in force and the national interest by establishing and publishing mistaken and incomplete standards different from those published by CNCCR and MAA, created by different means confusion at national level among the breeders and owners.

g)The boycott of the actions of CNCCR that brought in Bucharest the number one in the world chinology, the President of the Standard Commission of FCI, dr. J.M. Paschoud, in order to elaborate and verify the international homologation file of Romanian Shepherd dogs, by the circular letter sent by Mr. Petru Muntean.

h)The public recognition of Mr. Attila Kelemen of the premeditated disobeying of the decision of MAA given to CNCCR, published in 'Ziua' Newspaper.

CONCLUSIONS :

The homologation file of the breed of Romanian Shepherd dogs is ready to be handed over. Today the CNCCR has 20 blood lines on three known generations , without consanguinity(FCI requires minimum , the photo album is correctly made, the club has a strong internal infrastructure (10 branches-Bucharest, Azuga, Abrud, Craiova, Braila, Galati, Timisoara, Piatra_Neamt, Sibiu, Targoviste, Targu-Mures) and
international (USA, Italy, France, Germany, Belgium), the standard was elaborated and edited together with the president at that time of the Standards Commission of FCI, that sow the most valuable samples of the breed and personally checking the whole homologation file.
Because of the conflict from juridical and organizatorical point of view that lasts from 1990 by now, Romania can not hand over the homologation file hereabove mentioned, can not take part into the World Championship from 22-25 June 2000,in Milan, and can not be full member of FCI, and being in danger to be excluded from FCI, on the reasons stipulated hereabove.
This note fundaments totally the necessity of reorganizing the Romanian Chinologycal movement, for a better representation at national and international level.

Dear Mr. Secretary General,

After analyzing the administrative complaint registered with you under the number 20/5497/RS/12.07.2000 (submitted to you one day before
the Government’s meeting during which it was to be discussed the draft of the Governmental Decision for the completion of HG 1223/1996), complaint received from the so called “Romanian Kennel Association”, signed by Petru Munteanu in his capacity as president of the above “association”, we bring to your attention the official position of the Ministry of Food and Agriculture:
1.There is no association legally registered under the name of the “Romanian Kennel Association” with headoffices at 61, Popa Tatu Str., and has no registered president with the name of Petru Munteanu.
2.There is one association called the “Romanian Kennel Association” registered under the number 4407/PJ/1976 with head offices at 128, Calea Mosilor, having as president Mr. Vasile Maier, as per the final Civil Decision nr. 606 of 17 March 1999 issued by the Bucharest Tribunal and the one dated 30 June 1999 of the Bucharest Court, judged as final on 24 August 1999. Moreover, the letter nr. 033/30.06.2000 of the Romanian Kennel Association, addressed to Mr. Prime Minister, which copy we herewith attach, confirms all of the above and, more, informs us about the annulment of the stamp illegally used by Mr. Petru Munteanu.
3.The claimant misled the national and international public by illegally using the name of the association who they tried to substitute, with tragic repercussions today. They also mislead the International Kennel Federation (IKF). Only through a last minute intervention of our Ministry we could avoid Romania being expelled from the Federation, as well as the Romanian participation at the World Championship in Milan with the Romanian Shepherd dogs presentation.
4.Considering the approval of the legal measures to establish the Romanian National Kennel Authority as well as establishing the common measures necessary in order to avoid a possible international conflict which might arouse due to the fact that the IKF ignored the decisions made by the Romanian instances, received by them in official translation, the FCI therefore established a working meeting in Vienna, on 13 August 2000 with the representatives of the Ministry of Food and Agriculture. This underlines once more the necessity of a fast approval of the Governmental Decision for the completion of HG 1223/1996, in the form presented by the Ministry of Food and Agriculture.
5.The proposal regarding the establishment of the Romanian National Kennel Authority as a specialized commission, internationally representative, was made following preliminary consultations with the FCI and based on its statutes. We notice that the FCI’s statutes provides for the existence of a sole habilitated organization, expressly approved as such by the countries’ Governments (such habilitation was
granted in Romania by the Ministry for Food and Agriculture only for the Romanian Kennel Association with headoffices at 128, Calea Mosilor).
6.With regards to the so-called violation of the free association right and to the relationship between the public authority and the representatives of the associations, as described by the Ordinance 26/2000, we consider such allegations false and obviously meant
to mislead. The statutes of the Romanian National Kennel Authority, as stipulated by the draft for the completion of HG 1223/1996, mentions that this Authority will act as a centralized specialized commission which will elaborate the technical norms and the methodology for the entire kennel activity.
The Authority will also make available a series of means and instruments necessary for the carrying out of the kenneling activity. The Authority will, by no means, become an administrative structure for the management of the activities carried out by various kennel associations and foundations, as erroneously presented by the claimant. Moreover, according to the legislation in force, especially Law 40/1975 and HG
1223/1996, preparation of the technical programs of breeding, improvement and reproduction of all animal species are the task of the Ministry of Food and Agriculture and its specialized subordinated structure. The Romanian National Kennel Authority, subordinated to the ANARZ, will have as main task the elaboration of the methodological norms regarding the breeding, improvement and reproduction of dogs, as ANARZ is currently doing for other animal species.

We also send you, attached, an analysis of the files submitted by the claimant as well as by other legally constituted associations to the Ministry of Food and Agriculture for an updated evaluation of the kenneling activity in Romania. The analysis contains references to the above-mentioned files that, at your request, we will be glad to submit to you for further analysis.

Ne vedem fortati sa constatam atat incalcarea legii cat si a normelor deontologice jurnalistice de catre angajatii anumitor ziare si alte publicatii.Astfel, in urma convocarilor repetate la Ministerul Agriculturii si Alimentatiei a tuturor asociatiilor chunologice cu caracter national,inregistrate in evidentele juridice, precum si a documentelor solicitate a fi prezentate de catre acestea,s-au putut constata urmatoarele:
1.Nu exista nici o asociatie numita "Asociatia Chinologica din Romania"(AChR) cu sediul juridic in strada Popa Tatu nr. 61,Bucurestisi al carei presedinte inregistrat sa fie domnul Petru Munteanu.Mai mult,stampila folosita de acesta a fost declarata nula.
2.Exista o asociatie denumita "Asociatia Chinologica din Romania"(AChR) cu sediul juridic in Calea Mosilor nr. 128,Bucuresti, al carei presedinte inregistrat este domnul Vasile Maier,hotararile instantei referitoare la acestea fiind definitive inca din inie 1999.
3.Ezista dovezi certeca au fost emise un numar imens de mare de pedigree false,gresite sau neinregistrate,sub sigla Federatiei Chinologice Internationale, fara autorizatia acesteia.
4.S-a constatat incalcarea regulilor si regulamentelor vamale cu privire la modulin care se face inregistrarea expertizelor vamale, incasarile taxelor de evaluare vamala,autorizarea expertilor vamali, folosirea documentelor fiscale cu regim specialde catre un grup de persoane conduse de domnul Petru Munteanu (nu poate fi folosit numele de asociatie,deoarece din punct de vedere juridic ea nu exista sub denumirea folosita de "Asociatia Chinologica din Romania"(AChR) popa Tatu).S-au constatat de asemenea grave incalcari ale normelor si legilor in vigoare cu privire la regimul incasarilor valutare pe teritoriul tarii noastre din partea acestui grup.
5.In conformitate cu Legea 21/1924 cu privire la organizatiile nonguvernamentale,Ministerul Agriculturii si Alimentatiei are dreptul de a aviza si controla functionarea acestora si poate solicita instantei desfiintarea celei la care se constata ca nu respecta legislatia in vigoare.Dorindu-se respectarea cadrului juridic existent, toate partile implicate au fost invitate de doua ori de catre ministrul agriculturii si alimentatiei sa-si prezinte documentatia juridica si chinotehnica.Cu toate ca au fost instiintati si au luat la cunostinta,reprezentamtii din Popa Tatu nr. 61 nu s-au prezentat la prima intalnire,iar la a doua au prezentat un dosar ce cuprinde note de corespondenta, copii dupa articole din reviste de specialitate referitoare la bolile si parazitii cainilor,reclame la canise si cabinete medicale veterinare, fragmente din povesti cu caini etc., dar nici o hotarare judecatoreasca in masyra sa ateste autorizarea de functionare sub numele de "Asociatia Chinologica din Romania (AChR) nominalizata prin persoana domnului Petru Munteanu.Mai mult au facut dovada incalcarii hotararilor definitive ale instantelor de judecata romane prin continuarea efectuarii de plati la FCI si organizarea de concursuri si expozitii sub egida acestei organizatii.
6.Crearea tuturor premizelor pentru izbucnirea unui conflict de reprezentativitate in cadrul FCI-ului care ar putea determina excluderea Romaniei din aceasta organizatie.Situatia a fost creata prin diverse mijloace de catre persoane iresponsabile conduse de domnul Petru Munteanu si a fost manifestata prin nerespectarea hotararilir instantei de judecata romane, care le-au fost aduse la cunostiinta conducerii FCI, in forma tradusa si si autentificata.Primirea acestor documente a fost confirmata de directorul executiv al FCI, domnul Yves De Clercq, in cadrul interviului televizat prezentat de TVR 2 in emisiunea "Arca lui Noe",duminca 2 iulie 2000.
7.Dopa cum stipuleaza toate conventiile diplomatice, reorezentarea unei tari la nivel international este asigurata de un organism sau o institutie si nu o persoana sau grupare oarecare.Aceasta reprezentare se poate face fie direct prin acordul organismelor guvernamentale de resort, fie prin delegarea unei organizatii de profil.Astfel si AChR cu sediul in Calea Mosilor a primit din partea MAA, cu ani in urma, dreptul de reprezentare unica la FCI.Constatandu-se insa aceste grave situatii de fapt,MAA a luat decizia normala si legala de a crea un organism unic de reprezentare a tarii la FCI si anume Autoritatea Nationala Canina,iar pe baza consultarilor au fost nominalizati specialisti din toate partile implicate, al caror criteriu de selectie a fost doar cel al competentei.
8.In problema importului necontrolat de caini s-au constatat:
a.efectuarea de operatiuni de "spalari" de pedigree,pe teritoriul tarii;
b.incalcarea normelor sanitar veterinare in vigoare,fapt ce a facut posibila aparitia unor boli precum
bruceloza,cu posibile efecte foarte grave la nivelul intregii populatii canine
9.S-au incalcat de asemenea prevederile Ordinului MAA nr. 103/1998 cu privire la autorizarea caniselor si neplata taxelor catre stat.
10.In cea ce priveste sitruatia omologarii internationale a raselor autohtone, in urma analizelor efectuate pe baza documentatiilor depuse si a raspunsurilor directe a celor convocati, s- au constatat urmatoarele :
a. gruparea condusa de domnul Petru Munteanu nu a respectat prevederile deciziei nr. 17176/1998 a MAA
cu privire la ciobanescul romanesc si activitatea de omologare a lor acordata Clubului National de Caini
Ciobanesti Romanesti ( CNCCR ) in anul 1998, tot pe baza analizelor situatiei acestora la acea data,fapt
ce a starnit confuzie si haos, intr-o prima faza,printre detinatorii si crescatorii de astfel de caini, mai ales
prin "fabricarea" si publicarea unui standard de rasa total aberant,(ciobanescul mioritic nu ar trebui sa
aiba par,toate tipurile de par fiind considerate defecte eliminatorii ) ;
b. singura documentatie corect intocmita si verificata impreuna cu presedintele in exercitiu la acea data
(decembrie 1998) a Comisiei de Standarde a FCI, dr. J.M. Paschoud, invitat de domnul ministru Ioan
Avram Muresean special cu acest scop la Bucuresti, a fost cea prezentata de CNCCR..Tinand cont de
solicitarea CNCCR si de situatia ramanerii in urma a rasei ciobanesc carpatin, domnul ministru a luat
decizia infiintarii unei comisii nationale pentru aceasta rasa cu membri din toate zonele de crestere a
acestor caini.
Avand in vederecele prezentate,s-a decis infiintarea Autoritatii Nationale Canine din Romania (ANCR), cum atributii clar stipulate, care in nici un caz nu "nationalizeaza" cainii, asa cum initial persoane fara discernamant au emis opinii, ci creaza cadrul legal coerent, ca peste tot in lume, pentru desfasurarea tuturor activitatilor chinologice.
Ca urmare a implicarii personale a ministrului agriculturii in vederea unificarii miscarii chinologice si asigurarea transparentei desfasurarii activitatii acesteia,ANCR a putut prezenta in premiera absoluta ciobanestii mioritici la Campionatul Mondial de le Milano,in ringul de onoare,in aceeasi zi, 24 iunie2000,in care au fost prezenti 6000 de caini si peste un milion de spectatori.
Imnul national al Romaniei s-a facut auzit in incinta imensei sali de desfasurare a mondialelor canine datorita faptului ca Romania a fost reprezentata oficial de un organism aflat sub tutela Ministerului Agriculturii si Alimentatei, respectiv a Guvernului, si nu de o grupare inexistenta juridic.Acest lucru a fost clar exprimat de directorii executivi ai FCI si ENCI(Italia) care au subliniat atat acordul lor pentru includerea ANCR in FCI cat si pentru prezentarea ciobanescului romanesc mioritic la aceasta expozitie.
Referitor la faptul exprimat in presa ca MAA si Ambasada Italiei nu a acordat sprijinul pentru obtinerea vizelor si celorlalti participanti inscrisi la mondiale, tinem sa subliniem ca nimeni in afara membrilor CNCCR nu ne-au solicitat in acest sens iar in plus multumim inca o data pentru sprijinul personal acordat delegatiei romane de catre Consulul general al Italiei la Bucuresti.
Ramane evidenta pozitia personala a arbitrului maghiar prezent in ringul mondialelor de la Milano si exprimata Televiziunii Romane , care este total impotriva omologarii ciobanestilor romanesti , pozitie pe care nu o comentam .
Cu toate ca au fost trimise si la redactiile ziarelor comunicatele de presa ale MAA si ale Asociatiei Chinologice din Romania (AChR) - Calea Mosilor, legal constituita , unele dintre publicatii au preferat sa incalce atat legile in vigoare cu privire la verificarea autenticitatii surselor de informare, cat si regulile deontologice, ce obliga a se contacta biroul de presa al MAA inainte de publicare .

vous un jour avant la réunion du gouvernement pendant
laquelle ce devait ętre discuté l'ébauche de la
décision gouvernementale pour l'accomplissement de
l'decision gouvernementale nr. 1223/1996), la plainte
reçue de la prétendue "Association Chinologique
Roumaine ACHR", a signé par Petru Munteanu en sa
qualité de président de l'"association" ci-dessus,
nous portons ŕ votre connaissance la position
officielle du ministčre de la nourriture et de
l'agriculture
1. Il n'y a aucune association légalement enregistrée
sous le nom "Association Chinologique Roumaine ACHR"
avec les headoffices ŕ 61, rue Popa Tatu, Bucarest et
n'a aucun président enregistré avec le nom de Petru
Munteanu.
2.Il y a une association appelée "Association
Chinologique Roumaine ACHR" enregistrée sous le nombre
4407/PJ/1976 avec les sičges sociaux ŕ 128,rue Calea
Mosilor, ayant comme Président M. Vasile Maier, selon
le nr civil final de décision. 606 de 17 mars 1999 ont
publié par le tribunal de Bucarest.
3.Le réclamant a trompé le public national et
international en employant illégalement le nom de
l'association qu'ils ont essayé de substituer, avec
des répercussions tragiques aujourd'hui. Elles
trompent également la Fédération Chinologique
Internationale - FCI. Seulement par une derničre
interposition minutieuse de notre ministčre nous
pourrions éviter la Roumanie étant expulsée de la
fédération, aussi bien que la participation roumaine
au championnat du monde ŕ Milan avec la présentation
de chiens de berger de Roumain.
4.Vu l'approbation des mesures légales d'établir
l'Autorité Canine Nationale Roumaine aussi bien
qu'établir les actions communes nécessaires afin
d'éviter un conflit international possible qui
pourrait réveiller étant donné qui l'FCI a ignoré les
décisions prises par les exemples roumains, reçus par
eux dans la traduction officielle, l'FCI a donc établi

les représentants du Ministčre de la Nourriture et de
l'Agriculture. Ceci souligne une fois de plus la
nécessité d'une approbation rapide de la décision
gouvernementale pour l'accomplissement de decision nr.
1223/1996, sous la forme présentée par le Ministčre de
la Nourriture et de l'Agriculture.
5. La proposition concernant l'établissement de
l'Autorité Canine Nationale Roumaine en tant que
commission spécialisée, internationalement
représentatif, a été faite aprčs des consultations
préliminaires avec l'FCI et basée sur ses
statuts.Nous notons que les statuts de l'FCI prévoit
l'existence d'une organisation avancée des fonds
unique, expressément approuvée en tant que tels par
les gouvernements des pays (une telle habilitation a
été accordée en Roumanie par le ministčre de la
nourriture et agriculture seulement pour l'Association
Chinologique Roumaine – ACHR avec le headoffice in
128, rue Calea Mosilor, Bucharest)
6. Quant ŕ la prétendue violation de la droite libre
d'association et au rapport entre le service public et
les représentants des associations, comme décrit par
l'ordonnance 26/2000 nous considérons de telles
allégations fausses et évidemment signifiées pour
tromper. Les statuts de l'Autorité Canine Nationale
Roumaine, comme stipulés par l'ébauche pour
l'accomplissement de decision 1223/1996, mentionne que
cette autorité agira en tant que commission
spécialisée centralisée ce qui élaborera les normes
techniques et la méthodologie pour l'activité entičre
de chenil. L'autorité fera également disponible une
série des moyens et des instruments nécessaires pour
la mise en oeuvre de l'activité kenneling. L'autorité
, nullement, deviennent une structure administrative
pour la gestion des activités effectuées par de
diverses associations de chenil et des bases, comme
incorrectement présenté par le réclamant. D'ailleurs,
selon la législation en vigueur, particuličrement la
loi 40/1975 et decision 1223/1996, la préparation des
programmes techniques de la multiplication,
amélioration et reproduction de toute l'espčce animale
sont la tâche du Ministčre de la Nourriture et de
l'Agriculture et sa structure subordonnée spécialisée
.L'Autorité Canine Nationale Roumaine, subordonnée ŕ
l'ANARZ, aura en tant que tâche principale
l'élaboration des normes méthodologiques concernant la
multiplication, l'amélioration et la reproduction des
chiens, comme ANARZ fait actuellement pour l'autre
espčce animale
Nous vous envoyons également, attaché, une analyse des
dossiers soumis par le réclamant comme par autre des
associations légalement constituées au Ministčre de la
Nourriture et Agriculture pour une évaluation mise ŕ
jour de l'activité chinologiques en Roumanie.L'analyse
contient des références aux dossiers mentionnés
ci-dessus que, ŕ votre demande, nous serons heureux de
soumettre ŕ vous pour davantage d'analyse.

Nous nous voyons forcés de noter la coupure de la loi
aussi bien que des normes deontological
journalistiques par les employés de quelques journaux
et des publications.
Ainsi, la nombreuse on a conclu sommation suivante
Ministčre de la Nourriture et l'Agriculture ŕ toutes
les associations chinologiques nationales légalement
enregistrées et des documents relatifs présentés, le
suivant :
1. Il n'y a AUCUNE association appelée "l'Association
Chinologique Roumaine" (ACHR) avec les bureaux légaux
ŕ 61, rue de Popa Tatu, Bucarest, dont a enregistré le
président pour ętre M. Petru Munteanu. D'ailleurs, le
timbre employé par eux était nulle avouée
2. Il y a une association appelée "l'Association
Chinologique Roumaine" avec les bureaux légaux ŕ 128,
Calea Mosilor, Bucarest, dont a enregistré le
président est M. Vasile Maier. Les décisions de cour
en ce qui concerne cette association sont finales
depuis juin 1999
3. Il y a des preuves claires qu'un nombre énormément
énorme de pedigrees faux ou faux ont été publiées sous
l'en-tęte de lettre de la Fédération Chinologique
Internationale - FCI, sans son autorisation.
4.On l'a également noté la coupure des rčgles de
douane et les rčglements quant ŕ l'enregistrement des
évaluations de douane, l'encaissement des impôts de
douane pour de telles évaluations, l'autorisation des
experts douaniers, utilisation des documents avec le
régime spécial par un groupe de personnes mčnent par
M. Petru Munteanu le nom de l'association ne peut pas
ętre employé puisque - légalement - il n'existe pas
sous le nom " l'Association Chinologique Roumaine
ACHR Popa Tatu “). Il y avait des violations sérieuses
également notées des lois et des normes en vigueur
concernant les collections de devise forte forte dans
le territoire roumain
5. Selon la loi 21/1924 concernant les organisations
nonnes gouvernemental, le Ministčre de la Nourriture
et l'Agriculture a le droit d'approuver et commander
leur fonctionnement et peut demander devant le
tribunal d'ętre dissous s'ils cassent la législation
en vigueur. Avec l'intention claire d'observer la
législation, le Ministre de la Nourriture et
l'Agriculture a invité deux fois toutes les parties
concernées pour présenter leur documentation juridique
et technique. Bien qu'on les ait annoncé, les
représentants de 61 , rue Popa Tatu, Bucharest, n'a
pas assisté ŕ la premičre réunion et ŕ la seconde ils
n'ont présenté un dossier de correspondance, des
copies de quelques articles des magasins spécialisés
au sujet des maladies et des parasites des chiens, des
annonces, des histoires avec des chiens, etc., mais
aucune décision légale pour certifier l'un de
fonctionnement légale.sous le nom "de l'Association
Chinologique Roumaine " a nommé sous la personne de M.
Petru Munteanu. D'ailleurs, ils ont fait la preuve de
la coupure continue des décisions roumaines de cour en
continuant les paiements ŕ la Fédération Chinologique
Internationale - FCI et en organisant des concours
sous l'égide du FCI.
6. Création de tous les lieux pour la manifestation
d'un conflit de représentation dans l'FCI qui pourrait
déterminer l'exclusion de la Roumanie de cette
organisation. Ces personnes irresponsables, menées par
Mr.Petru Munteanu, créé la situation par de divers
moyens et lui ont été manifestées par la inobservance
des décisions roumaines de cour, les décisions qui ont
été aussi bien envoyées ŕ l'FCI, traduites et
authentifiées La réception de telles décisions de cour
a été confirmée par M. Yves de Clercq, pendant une
entrevue montrée sur TVR2 au "lui Noe d'Arca" 2
juillet 2000.
7.La représentation internationale d'un pays, comme
stipulée par n'importe quelle convention diplomatique,
est assurée par une organisation ou un établissement
et pas par une personne ou un groupe. Une telle
représentation peut ętre faite directement par
l'accord des organismes gouvernementaux correspondants
ou il peut ętre fait par la délégation d'une
organisation spécialisée. En tant que tels,
l'Association Chinologique Roumaine - Calea Mosilor a
reçu il y a des années du Ministčre de la Nourriture
et de l'Agriculture la droite de la représentation
unique au ou il peut ętre fait par la délégation d'une

unique au FCI. Mais plus tard, notant la situation
grave décrite ci-dessus, le ministčre normalement et
légalement décidée pour créer un corps représentatif
unique avec l'FCI, c.-ŕ-d. l'Autorité Canine Nationale
Roumaine. Suivre des discussions, spécialistes ont été
nommées de toutes les parties concernées, les critčres
de sélection uniques étant celle de compétence.
8. Concernant l'importation non contrôlée des chiens,
ce qui suit a été noté : - opérations laundrying de
pure race dans la Roumanie ; - urgence des maladies
telles que la brucellose due ŕ l'infraction ŕ des
normes vétérinaires et sanitaires en vigueur, les
maladies qui peuvent avoir des effets négatifs énormes
au-dessus de cela peut avoir des effets négatifs
énormes au-dessus de la population canine entičre.
9.. Il y avait des violations également notées de
l'ordonnance 103/1998 publiée par le ministčre de la
nourriture et de l'agriculture concernant autorisation
des établissements et du non-paiement des impôts
relatifs au budget d'état.
10.. Quant ŕ l'homologation internationale des races
nationales, aprčs une analyse exécutée basée sur la
documentation soumise et des réponses reçues, on a
conclu ce qui suit:
- le groupe mené par M. Petru Munteanu n'a pas
observé les dispositions de la décision 17176/1998
publiée par le Ministčre la Nourriture et
l'Agriculture quant aux chiens de berger de Roumain et
de l'activité d'homologation accordée en 1998 au Club
National des Chiens Roumains de Berger - CNCCR La
inobservance d'une telle décision a créé la confusion
et le chaos avec les propriétaires et les
sélectionneurs de tels chiens, particuličrement aprčs
la "création" et publication par le groupe ci-dessus
d'une norme anormale de race ( comme exemple, selon
cette norme, le berger roumain Mioritic ne devrait pas
avoir des cheveux, tous les types de cheveux étant
considérés comme défaut eliminatory )
- la plante du pied a correctement préparé la
documentation vérifiée ainsi que le président
responsable ŕ ce moment-lŕ (décembre 1998) de la
Commission de normes de l'FCI, Dr. J.M. Paschoud,
particuličrement invité ŕ Bucarest par M. Ioan Avram
Muresan, ministre de nourriture et l'agriculture,
était celle présentée prčs CNCCR. Considérant la
demande de CNCCR's et le ralentissement derričre du
berger roumain "Carpatin", M. Minister a décidé
l'installation d'une commission spéciale pour cette
race avec des membres de tous les secteurs oů ces
chiens sont race.
Vu toute la ce qui précčde, on l'a décidé
l'installation de l'Autorité Canine Nationale
Roumaine, avec les prérogatives clairement stipulées,
que - nullement - tendra "nationalisent" les chiens,
comme au commencement été d'avis par quelques
personnes irresponsables L'autorité créera, en tant
que n'importe oů ailleurs dans le monde, un cadre
juridique logique pour la mise en oeuvre de toutes les
activités kenneling.

Vu toute la ce qui précčde, on l'a décidé
l'installation de l'Autorité Canine Nationale
Roumaine, avec les prérogatives clairement stipulées,
que - nullement - tendra "nationalisent" les chiens,
comme au commencement été d'avis par quelques
personnes irresponsables. L'autorité créera, en tant
que n'importe oů ailleurs dans le monde, un cadre
juridique logique pour la mise en oeuvre de toutes les
activités kenneling.
Aprčs la participation personnelle du ministre de la
nourriture et de l'agriculture pour l'unification de
tous les organismes chinologique et s'assurer d'une
activité transparente, l'autorité pouvait présenter
pour la premičre fois le chien roumain de berger
Mioritic au Championnat du Monde - Milan 2000 oů plus
de 6000 chiens ont été exhibés devant plus d'un
million de spectateurs.
L'anthem national de la Roumanie a été entendu dans
l'immense hall étaient le championnat a eu lieu étant
donné que la Roumanie a été officiellement représentée
par une organisation sous le patronage du Ministčre de
la Nourriture et de l'Agriculture, du Gouvernement
Roumain et pas par un groupe légalement non-existant.
Cette opinion a été clairement exprimée par les
directeurs exécutifs du FCI et d'ENCI (Italie) qui ont
souligné les deux leur accord pour l'inclusion de l'
Autorité Canine Nationale Roumaine dans FCI aussi bien
que pour la présentation du berger roumain Concernant
les réclamations a augmenté en quelques journaux que
le Ministčre de la Nourriture et de l'Agriculture et
l'Ambassade de l'Italie n'ont pas soutenu d'autres
participants pour obtenir des visas, nous soumettent ŕ
une contrainte hors du fait que personne excepté les
membres de CNCCR n'a demandé de tels visas et
d'ailleurs, nous remercions de nouveau de l'appui
personnel accordé par le Général Counsel de l'Italie ŕ
la délégation roumaine.
Ce reste en tant qu'évident la position personnelle
exprimée par l'arbitre hongrois présent ŕ Milan ŕ la
télévision roumaine comme étant totalement opposé ŕ
l'homologation des chiens roumains de berger. Nous ne
faisons aucun commentaire
Bien que communiqués de presse du Ministčre de la
Nourriture et l'Agriculture et l'Association
Chinologique Roumaine ACHR - Calea Mosilor, légalement
constitué, ont été envoyés également aux journaux,
certains d'entre eux ont préféré casser les lois en ne
vérifiant pas l'authenticité de leurs émetteurs
d'informations et de ne pas entrer en contact avec le
bureau de pression du ministčre de la nourriture et de
l'agriculture avant publication
